TIMBER LEASES AND LICENCES (AMENDMENT) REGULATIONS, 1979 (LI 1215).  

 

IN exercise of the powers conferred on the Commissioner responsible for Lands by subsection (1) of section 14 of the Concessions Act, 1962 (Act 124) these Regulations are made this 16th day of August, 1979.

Regulation 1—L.I. 229 Amended.

The Timber Leases and Licences Regulations, 1962 (L.I. 229) as amended are hereby further amended as follows:

(i) by the substitution for paragraphs (a) and (c) of regulation 1 thereof, of the following new paragraphs:

(a) be made to the Commissioner in writing and shall be in such form and contain such of the particulars specified in the First Schedule to these Regulations as are appropriate to the application.

(c) be accompanied by—

(i)  the appropriate fee prescribed in relation to an application of that type in the Second Schedule to these Regulations."

(ii) by the substitution for the words “Third Schedule” appearing in regulation 7 thereof of the words “Second Schedule”.

(iii) by the substitution for the First, Second and Third Schedules thereto of the following new Schedules:

SCHEDULES

“FIRST SCHEDULE

APPLICATION FOR TIMBER LEASE OR LICENCE

1. Name of Applicant.

2. Address (Registered Offices) of applicant.

3. Nationality or country of incorporation.

4. Names, nationality and addresses of partners or directors.

5. Name, address and nationality (country of incorporation) of holding company or of majority shareholder.

6. Period for which lease or licence is required.

7. (a) Whether applicant has ever been granted any timber rights in this country and, if so, when, where, size of area granted, rent payable and property mark registered.

(b) Have all rents and royalties and other impositions been paid? If so, produce receipts.

(c) Has the old concession been worked? If so, give details, including extent of area worked and wood disposal.

(d) Has any of the rights granted been assigned and If so, when, where and to whom?

8. Amount of nominal and paid up capital of applicant and cash working capital available for expenditure in Ghana.

9. Name of Bankers of applicant both in and outside Ghana.

10. Whether applicant or associated firms held at any time any timber rights in another country and, if so, where?

11. Whether operations in that country/countries have ceased and if so, where, when and whether by revocation, forfeiture, expiry or termination of rights.

12. Where applicant is a party to any contracts for the sale of timber.

13. Particulars of such contracts (N.B.—Enclose 3 copies).

14. Estimated annual production of timber specifying species of trees.

15. What ancillary rights are required.

16. Whether applicant intends to produce logs only.

17. Particulars (including type and age) of machinery and trucks possessed by applicant and whether owned or hired.

18. Particulars of installations which applicant intends to construct (including workers’ camps, offices, bungalows, etc).

19. Whether applicant intends to establish a forest conversion unit, i.e. sawmill, plywood plant, pulp and paper industry. If so, give details including size and time for completion and estimated quantity of raw materials to be processed annually. Enclose a feasibility Report.

20. Whether applicant intends to sell timber or its products only, and if so, where and to whom or intends to use timber solely for his own purposes and, if so, for what purposes.

21. Particulars of balance sheets profits and loss accounts, annual reports and auditors reports for the last five years. (N.B.—Enclose three copies of each document).

22. What proportion of his profits applicant intends to reinvest in Ghana and how.

23. Description of area with reference to a topographical map in a manner permitting identification on the ground and containing approximate size of area in square kilometers. (N.B.—Enclose three copies).

24. Sketch map showing area and situation of any installation with reference to a topographical map. (N.B.—Enclose three copies).

25. Can applicant pay a refundable deposit not exceeding ˘5,000.00 per square kilometre in respect of a Performance Surety Bond?

26. Name of the Stool which owns the area applied for.

27. Address of the District Chief Executive for the area.

28. I hereby declare the above particulars to be true.

Regulation 2—Revocation.

The Timber Leases and Licences (Amendment) Regulations, 1978 (L.I. 1165) are hereby revoked.
