SCHEDULE.

SEKONDI-TAKORADI PLANNING AREA—DESCRIPTION OF BOUNDARIES.

All that area at Sekondi and Takoradi the boundary of which commencing at a point on Low Water Mark on the Gulf of Guinea and approximately 3,000 feet west from the centre of Funko village runs in a northerly direction for approximately 11,600 feet to the north-eastern corner of the bridge where the main Takoradi-Axim road crosses the Whin River and thence in a north-north-easterly direction for approximately 15,300 feet to a point approximately 2,800 feet north-west from the 6-Mile Post on the old Sekondi-Axim road and thence in a north-easterly direction for approximately 8,200 feet to a point approximately 4,500 feet north from the 5-Mile Post on the old Sekondi-Axim road and thence in an easterly direction for approximately 5,800 feet to a point approximately 2,800 feet north-east from the 4-Mile Post on the old Sekondi-Axim road and thence in a north-easterly direction for approximately 9,000 feet to a pillar marked S.T.B. 4 near the Sekondi-Kumasi Railway and approximately 1,600 feet north-north-west from the 3-Mile Post on the said Railway and thence in an east-north-easterly direction for approximately 5,300 feet to a pillar marked S.T.B. 5 approximately 500 feet south from the centre of Mpinti village and thence in an east-south-easterly direction for approximately 8,300 feet to a pillar marked S.T.B. 6 near the Sekondi-Cape Coast road and approximately 200 feet south-west of the 3-Mile Post on the said road and thence in a south-south-easterly direction for approximately 1,600 feet to a pillar marked S.T.B. 7 and thence in a southerly direction for approximately 1,100 feet passing through a pillar marked S.T.B. 8 to a point on Low Water Mark on the Gulf of Guinea and approximately 4,100 feet east-north-east from the 2-Mile Post on the Sekondi-Cape Coast road and thence follows the said Low Water Mark in a general south-westerly direction to the Lee Breakwater of Takoradi Harbour and thence follows the northern edge of the said Lee Breakwater in an easterly direction to its most north-easterly point and thence runs in an east-north-easterly direction to the most north-westerly point of the Main Breakwater and thence follows the northern and eastern and southern edges of the Main Breakwater to Low Water Mark on the Gulf of Guinea and thence follows the said Low Water Mark in a general westerly direction to the point of commencement as the same area is more particularly delineated and shown edged with green colour on a plan numbered Z. 1806 and signed on behalf of the Director of Surveys on the 11th day of December, 1945.

CAPE COAST PLANNING AREA—DESCRIPTION OF BOUNDARIES.

ACCRA PLANNING AREA—DESCRIPTION OF BOUNDARIES

Commencing at a point on the Low Water Mark of the Gulf of Guinea approximately 2,600 feet west of the village of Grefi the boundary runs due north for approximately 100 feet to a pillar marked G.C.S.A.T.B.E.P. 5/24/32 and thence runs on a bearing of 359º 55' for approximately 28,382 feet to a pillar marked G.C.S.A.T.B.E.P. 5/24/42 and thence on a bearing of 56 degrees 48' for approximately 23,292 feet to a pillar marked G.C.S.S.S. 11 and thence on a bearing of 56º 57' for approximately 9,900 feet to a pillar marked G.C.S.S.S.32 passing through a pillar marked G.C.S.S.S.35 and thence on a bearing of 359º 55' for approximately 5,500 feet to a pillar marked G.C.G.E.P. 8/47/35A and thence on a bearing of 66 degrees 14' for approximately 6,825 feet to a pillar marked G.C.G.E.P. 8/47/4/A and thence on a bearing of 92º 40' for approximately 4,016 feet to a pillar marked G.C.G.E.P. 49/51/1 and thence on a bearing of 89º 55' for approximately 3,440 feet to a pillar marked G.C.G.E.P. 49/51/4 and thence on a bearing of 119 36' for approximately 38,275 feet to a pillar marked G.C.G.E.P. 7/52/10 and thence on a bearing of 123º 01' for approximately 6,762 feet to a point on the Low Water Mark of the Gulf of Guinea and thence follows the Low Water Mark of the Gulf of Guinea in a south-westerly direction to the point of commencement as the same is more particularly delineated and shown edged pink on a plan numbered X. 2185 and deposited in the office of the Director of Surveys.

KUMASI PLANNING AREA—DESCRIPTION OF BOUNDARIES

Commencing at a pillar marked G.C.G.A. 7/45/1 which pillar is on the northern boundary of the Agricultural Station at Kwadaso and is on the southern side of the Kumasi-Toasi motor road, near its junction with the road from Tanoso to Apatrapa the boundary runs for 7,947.1 feet on a bearing of 29° 31' — which bearing together with all further bearings hereinafter mentioned is referred to the meridian of 1° west longitude— to a pillar marked G.C.G.A. 4/30/9 situate on the southern boundary of the land acquired for the Kumasi Water Supply and thence follows the boundary of the said land firstly in an easterly direction passing through the pillars marked G.C.G.A. 4/30/8/7 to a pillar marked G.C.G.A. 4/30/6 and then on a northerly direction passing through the pillars marked G.C.S.A. 4/30/5, /3, /2, /231, /231A, /27, /28, /232, /29, /30, to a pillar marked G.C.G.A. 4/30/31 and thence in a westly direction passing through the pillars marked G.C.G.A 4/30/32, /33, to a pillar marked Boadi village and approximately 300 feet south-east of Kotei village to a pillar marked G.C.G.A. 1/45/K.T.B.7 which pillar is approximately 900 feet south-east of the 14-Mile Post on the Kumasi-Kuntanasi motor road and thence on a bearing of 271º 54' for 22,549.6 feet to a pillar marked G.C.G.A. 1/45/K.T.B.6 which pillar is near Atasomanso village and is approximately 250 feet east of the road from Atasomanso to Ohenaba Kokobin and thence on a bearing of 317º 22' for 13,432.0 feet to a pillar marked G.C.G.A. 7/45/20 which pillar is on the northern edge of the Krumuasi-Nsima-Kumasi road and is on the southern boundary of the Agricultural Station at Kwadaso and thence follows the boundary of the said Agricultural Station firstly in a north-westerly direction passing through the pillars marked G.C.G.A. 7/45/19, /18 to a pillar marked G.C.G.A. 7/45/17 and then in a south-westerly direction passing through the pillars marked G.C.G.A. 7/45/16, /15, /14, /13, to a pillar marked G.C.G.A. 7/45/12 which pillar is on the north-western side of the aforesaid Krumuasi-Nsima-Kumasi road and then in a north-westerly direction passing through the pillars marked G.C.G.A. 7/45/11, /10, /9, /8 to a pillar marked G.C.G.A. 7/45/7 and then in a north-westerly direction passing through the pillars marked G.C.G.A. 7/45/6, /5, to a pillar marked G.C.G.A. 7/45/4 which pillar is on the the point of commencement as the same is more particularly delineated and shown edged pink on a plan numbered X. 2201 and deposited in the office of the Director of Surveys.

SWEDRU PLANNING AREA—DESCRIPTION OF BOUNDARIES

SUNYANI PLANNING AREA—DESCRIPTION OF BOUNDARIES

Commencing at a Gold Coast Survey pillar marked S.T.B. 2 which pillar is situate on the south-west side of the Berekum-Kumasi Road and approximately 4,470 feet as measured south-east along the said road from its junction with the Wenchi Road and is distant on a bearing of 130º 12'—which bearing together with all further bearings hereinafter mentioned is referred to true north—890.9 feet from a Gold Coast Survey pillar marked A. 37/25/7 runs on a bearing of 277º 34' for a distance of 10,609 feet to a pillar marked S.T.B. 1 and thence runs on a bearing of 360º for a distance of 13,500 feet to a pillar marked S.T.B. 5 and thence runs on a bearing of 115º  2' for a distance of 4,183 feet to a pillar marked S.T.S. 22 and thence runs on a bearing of 83º 8' for a distance of 4,460 feet to a pillar marked S.T.S. 23 situated on the north-west side of the Sunyani-Odumasi Road and thence runs on a bearing of 103º 54' for a distance of 2,184 feet to a pillar marked S.T.B. 4 and thence runs on a bearing of 175º  46' for a distance of 7,130 feet to a pillar marked S.T.B. 3 situated on the south side of the aforesaid Wenchi Road and thence runs on a bearing of 183º 9' for distance of 6,022 feet to the point of commencement be the same several dimensions little more or less as the same premises are more particularly delineated on a plan numbered X. 1133 and signed by the Officer-in-Charge Cadastral  Branch Gold Coast Survey Department on the 30th day of March, 1931, which plan is deposited with the Director of Surveys.

This Order may be cited as the Cape Coast Town Planning Preliminary Scheme No. 1 (Part 1 ) (Approval) Order.

Order 2—Approval of Scheme.

The Cape Coast Town Planning Preliminary Scheme No. 1 (Part 1) is hereby approved.

Order 1—Title.

This Order may be cited as the Accra Town Planning Scheme No. 1 Korle Gonno Preliminary Scheme (Approval) Order.

Order 2—Approval of Scheme.

The Accra Town Planning Scheme No. 1, Korle Gonno Preliminary Scheme is hereby approved.

This Order may be cited as the Kumasi Town Planning Preliminary Scheme No. 1 (Part 1) (Approval) Order.

The Kumasi Town Planning Preliminary Scheme No. 1 (Part 1) is hereby approved.

SECTION 38.—REGULATIONS.

Regulations Nos. 7 of 1947, 26 of 1948,  43 of 1948.

PART I—PRELIMINARY.

Regulation 1—Title.

These Regulations may be cited as the Town and Country Planning Regulations.

Regulation 2—Interpretation.

In these Regulations, unless the context otherwise requires—

(a) "approved date" means the date upon which the Minister, under section 20 of the Ordinance, approved the scheme;

(b) "Board" means the Town and Country Planning Board established under section 3 of the Ordinance;

(c) "declared date" means the date of publication in the Gazette of the Order of the Governor in Council (made under section 9 of the Ordinance) declaring a Planning Area;

(d) "member" means a member of the Board;

(e) "permission to develop" means the permission granted under section 10 (1) of the Ordinance;

(f) "President" means the President of the Board;

(g) "scheme plan" includes every plan prepared with respect to a scheme;

(h) "Secretary" means the Secretary and Executive  Officer of the Board;

(i) "Municipal Council" includes any statutory local authority other than a Native Authority;

(j) "Municipal Councils Ordinance" means the Ordinance establishing the Municipal Council concerned;

(k) "the declaration plan" means the plan referred to in section 9 (1) showing the extent of Planning Area.

PART II—PROCEDURE.

Regulation 3—Minutes.

(1) Minutes of all the proceedings of the Board shall be regularly entered by the Secretary in a Minutes Book kept for the purpose; and such minutes shall, after approval, be signed at the next ensuing meeting by the person presiding thereat.

(2) The Secretary shall furnish the Minister with a certified true copy of confirmed minutes of each meeting.

Regulation 4—Committees.

(1) The Board may from time to time appoint out of their number such and so many committees consisting of such number of persons as it shall think fit for any purpose which the Board thinks would be better regulated or managed by means of such committees. Such committees may be Standing Committees or appointed for a special purpose.

(2) The proceedings of every such committee shall be subject to the approval of the Board.

Regulation 5—Authentication Notices.

All notices given by the Board shall be deemed to be sufficiently authenticated if signed by the Secretary.

Regulation 6—Custody of Documents.

The Secretary shall have the charge and custody of and be responsible for all books, plans, deeds, records and other documents; and these shall be kept as the Board directs.

Regulation 7—Form of Notices.

Any notice, request, permit or application given or made under the provisions of the Ordinance shall be given or made in the appropriate form specified in the Schedule to these Regulations:

Provided that where the Board has delegated its powers under section 12 of the Ordinance the appropriate forms shall be used with such modifications as may be appropriate.

Regulation 8—Document and ma for Submission Govern to be in Duplicate.

Any scheme and the scheme plan submitted under section 20 of the Ordinance for the approval of the Minister shall be prepared in duplicate, each of the duplicates being sealed with the Common Seal of the Board.

Regulation 9—Service of Notices. Cap 84.

(1) Any notice, summons, writ or other proceeding at law or otherwise required to be served on the Board for any of the purposes of the Ordinance may be served by delivering it to the Secretary of the Board, or by sending it by post in a registered letter addressed to the Secretary at the office of the Board.

(2) Subject to the provisions of paragraph (1) of this regulation, any notice, order or other document required or authorised to be served under the Ordinance may be served either—

(a) by delivering it to the person on whom it is to be served;

(b) by leaving it at the usual or last known  place of abode of that person;

(c) by sending it in a registered letter addressed to that person at his usual or last known place of abode;

(d) in the case of a company or body incorporated in the Gold Coast, by delivering it to the secretary of the company or body at its registered or principal office or sending it in a registered letter addressed to the company or body at such office;

(e)  in the case of a company or body incorporated outside the Gold Coast, by delivering it to the individual resident in the Gold Coast in charge of the operations of the company or body in the Gold Coast or sending it in a registered letter addressed to such individual at the principal office of the company or body in the Gold Coast; or

(f)  if it is not practicable after reasonable inquiry to ascertain the name or address of any person on whom it should be served, by addressing it to him by the description of "owner" or "lessee" or "occupier" of the premises, naming them to which it relates, and by delivering it to some person on the premises or, if there is no person on the premises to whom it can be delivered, by affixing it, or a copy of it, to some conspicuous part of the premises.

Regulation 10—Secretary of Planning Committees.

The Board may appoint one member of a Planning Committee to be the Secretary to such Committee.

PART III—DEPOSIT, PUBLICATION AND SUBMISSION OF SCHEMES.

(a) Deposit of Schemes.

Regulation 11—Deposit of Schemes.

When a scheme has been approved by the Minister the original thereof shall be deposited in the archives of the Board.

(b) Publication of Schemes.

Regulation 12—Final Deposit of Schemes.

The Board shall give notice of the approval or disapproval of a scheme by advertisement in two consecutive issues of the Gazette and in two consecutive issues of any local daily paper, and shall in the event of an approval include in the advertisement a statement that the scheme as approved and the scheme plan or certified copies thereof are open for inspection at a place, and between hours and dates, to be specified in the advertisement.

PART IV—MODIFICATION AND REVOCATION.

Regulation 13—Modification and Revocation of Schemes.

The procedure contained in Part III of these Regulations with regard to the deposit and advertisement of schemes shall apply to the modification  and revocation of schemes.

PART V—OBTAINING INFORMATION.

Regulation 14—Obtaining Information.

Every Municipal Council shall within four weeks from the date of a notice served thereon deliver free of charge to the Board such copies of or extracts from Assessment Rolls, Valuation Rolls, Rate Books, maps, plans and other similar documents in its possession as the notice may specify or require.

Regulation 15—Inspection.

Every Municipal Council shall allow any officer of the Board to inspect any Assessment Rolls, Valuation Rolls, Rate Books, maps, plans and take copies of any portion thereof free of charge.

PART VI—MISCELLANEOUS.

Regulation 16—Extension of Time and Dispensation.

The Board may, if they think fit in any particular case and subject to such conditions as they may impose, extend the period during which anything is required to be done under these Regulations or dispense with any of the requirements of these Regulations, other than requirements made obligatory under the Ordinance.
