AN ORDINANCE to facilitate the control of Tsetse Fly and for purposes connected therewith.

Date of Commencement: 17th December, 1955.

BE IT ENACTED by the Legislature of the Gold Coast, as follows:—

Section 1—Short Title.

This Ordinance may be cited as the Tsetse Fly (Control) Ordinance, 1955.

Section 2—Powers of Officers Authorised for Purposes of Control of Tsetse Fly.

Every public officer whose duties include measures for the control of tsetse fly and who is authorised by the Minister responsible for agriculture for the purposes of this Ordinance, shall be empowered to go on any land to carry out any survey and to do or cause to be done all things necessary for effecting the control of tsetse fly including, and without derogation from the generality of the foregoing, the felling and burning of any trees and bushes which in the opinion of such public officer encourage the breeding of tsetse flies:

Provided that reasonable notice of the intention to exercise any such powers in respect of any land shall be given to the owner or occupier of the land.

Section 3—Payment of Compensation.

Wherever it appears to the Minister responsible for agriculture just and equitable that compensation should be paid to any person who has sustained pecuniary loss by reason of any measures taken in exercise of powers conferred by section 2 of this Ordinance he may authorise payment out of the general revenue to any such person the such sum as to him shall seem fit:

Provided that nothing in this section contained shall entitle or shall be deemed to entitle any person as of legal right to receive compensation in respect of any loss sustained by reason of the exercise of such powers.

Section 4—Penalties.

Any person who either—

(a) without the consent of a public officer authorised under section 2 of this Ordinance removes any trees or bushes felled in exercise of any power conferred under the provisions of section 2 of this Ordinance; or

(b) without reasonable excuse obstructs, resists, or interferes with any public officer in the lawful exercise of his powers and duties under section 2 of this Ordinance;

shall be liable to a fine not exceeding ten pounds or in default to imprisonment for a term not exceeding two months.
