IN exercise of the powers
conferred on the Board of the
Ghana Water and Sewerage
Corporation by section 14 of the
Ghana Water and Sewerage
Corporation Act, 1965 (Act 310),
and with the approval of the
Minister responsible for Works and
Housing these Regulations are made
this 25th day of November, 1994.
Regulation 1—Water Charges.
The owner or occupier of a house
or premises specified in the
Schedule to these Regulations
shall be liable to pay to the
Ghana Water and Sewerage
Corporation (referred to as the
"Corporation") the charges
specified in the Schedule for the
supply of water and sewerage
services within Ghana.
Regulation 2—Notification of
Liability.
(1) Any amount due in respect of
water charges, meter rent, work in
connection with the supply of
water or any other charges shall
be payable within twenty-eight
days from the date on which
notification is given that the
amount is due.
(2) Where any amount due under
these Regulations is not paid
within twenty-eight days, the
Corporation may serve a notice on
the owner or occupier of the house
or premises to which the amount
relates to the effect that
settlement should be made within
seven days, and in default of
payment the Corporation shall cut
off the supply of water or
discontinue its services and may
take action in the court for the
recovery of the amount due with
interest calculated at the
prevailing bank rate at the time
of the judgement.
(3) Where the supply of water is
cut off from any house or premises
in accordance with sub-regulation
(2) of this regulation or at his
request, the owner or occupier of
the house or premises shall pay to
the Corporation the reconnection
fee specified in the Schedule to
these Regulations before the
service is reconnected.
Regulation 3—Notice.
(1) Any notice to be served under
these Regulations shall be deemed
to be properly served—
(a) if sent by post to the usual
or last known address of the owner
or occupier of the house or
premises;
(b) if delivered personally to the
owner or occupier of the house or
premises or his agent; or
(c) if left upon the house or
premises in respect of which the
notice is served.
(2) Where a notice is served by
post it shall, unless the contrary
is proved, be deemed to have been
served at the time at which it
would have been delivered in the
ordinary course of post.
Regulation 4—Illegal Connections.
No person shall without the
authority of the Corporation—
(a) make any connection to any
installation for the supply of
water; or
(b) tamper with any installation
for the supply of water.
Regulation 5—Offences.
Any person who—
(a) without the authority of the
Corporation reconnects any supply
of water which has been cut off in
accordance with regulation 2 (2);
or
(b) without the authority of the
Corporation makes any connection
to any installation for the supply
of water contrary to regulation 4
(a); or
(c) tampers with any installation
for the supply of water contrary
to regulation 4 (b).
commits an offence and is liable
on conviction to a fine not
exceeding ¢500,000.00 or to
imprisonment for a term not
exceeding twelve months or to
both.
Regulation 6—Revocation.
The following Instruments are
hereby revoked—
(a) Water Charges Regulations,
1980 (L.I. 1255); and
(b) Water Charges (Amendment)
Regulations, 1984 (L.I. 1297).
