WILDLIFE CONSERVATION (AMENDMENT) REGULATIONS, 1989[sic] ( LI 1452).  

 

IN exercise of the powers conferred on the Provisional National Defence Council by section 11 of the Wild Animals Preservation Act, 1961 (Act 43), these Regulations are made this 4th day of July, 1989.

Regulation 1—L.I. 685 Amended.

The Wildlife Conservation Regulations, 1971 (L.I. 685) as amended are hereby further amended as follows—

(a) by the insertion immediately after sub-regulation (4) of regulation 4 thereof of the following new sub-regulations:

"(5) No persons shall at any time, as group hunters, hunt, capture or destroy any wild animal;

(6) Sub-regulation (5) shall not apply to hunting in a group by any persons for the purpose of a cultural festival for which a licence has been granted";

(b) by the substitution for regulation 5 thereof of the following new regulation

"5. Offences.

Any person who contravenes any provision of regulation 1 to 4 shall be guilty of an offence and liable on conviction to a fine not exceeding ¢10,000.00 or to imprisonment for a term not exceeding twelve months or to both and any vehicle or implement found to have been used in the commission of the offence shall be confiscated to the State".

(c) by the insertion immediately after regulation 6 of the following new regulations:

"6A. Trading in Bush Meat without Licence Prohibited.

(1) No person shall trade in bushmeat unless he is the holder of a licence granted to him for that purpose.

(2) An application for a licence under this regulation shall be made to the Chief Game and Wildlife Officer or his representative in the District of the residence of the applicant and shall be accompanied by such fees as the Chief Game and Wildlife Officer shall determine.

(3) Eighty per cent of all fees collected for licences issued under this regulation shall be paid into the account of the relevant District Assembly and the remaining twenty per cent shall be paid into central government account.

"6B. Keeping of Wild Animals without Licence Prohibited.

(1) No person shall keep a wild animal as a pet unless he is the holder of a licence issued by the Chief Gama and Wildlife Officer or his representative for that purpose.

(2) Application for licence to keep a wild animal as a pet shall be made in writing to the Chief Game and Wildlife Officer or his representative in the area of residence of the applicant accompanied by such fees as may be determined by the Chief Game and Wildlife Officer.

(3) The Chief Game and Wildlife Officer may in granting a licence under this section stipulate the  conditions under which the wild animal shall be kept.

(4) A licence granted under this section may for stated reasons be withdrawn and the pet confiscated to the State.

(5) All fees collected for licences issued under the regulations shall be paid into central government account

(6) Any person who contravenes any of the provisions or regulation 6A or 6B commits an offence and shall on conviction be liable to a fine not exceeding ¢10,000.00 or to imprisonment for a term not exceeding twelve months or to both”.

(d) by the insertion immediately after sub-regulation (1) (c) of regulation 9 thereof of the following paragraphs:

“(d) where he has reason to suspect that the licence will be used for group hunting or that clubs, sticks, cudgels or dogs will be used in the hunting; or.

(e) where the applicant is known to be involved in group hunting or associated with group hunters”;

(e) by the insertion immediately after sub-regulation (2) of regulation 14 thereof of the following:

“(3) Where an exporter has been convicted of any infringement against any rules, regulations or directions relating to export trade of wildlife such person shall be banned from exporting wildlife for such period as the Chief Game and Wildlife Officer shall determine”.

Regulation 2—Interpretation

In these regulations unless the context otherwise requires—

“bushmeat” means  meat from any wild, undomesticated animal; and

“group hunting” means a group of two or more individuals hunting together and whose activities complement one another’s for the purpose of hunting.

Regulation 3—Commencement

These Regulations shall be deemed to have come into force on the 17th day of March, 1989.
