                        NATIONAL REDEMPTION COUNCIL DECREE

 

YENDI SKIN AFFAIRS DECREE, 1974 (NRCD 299)

 

ARRANGEMENT OF SECTIONS

Section

1. Mahamadu Abudulai’s Enskinment, etc. declared null and void.

2. Mahamadu Abudulai not to purport to be Chief.

3. No Person to recognise Mahamadu Abudulai.

4. Application.

WHEREAS on the 18th day of August, 1972 the National Redemption Council appointed a Committee of Inquiry to inquire into certain matters relating to the Yendi Skin:

AND WHEREAS the said Committee found that the purported nomination, selection and enskinment of Mahamadu Abudulai as Ya-Na was null and void:

AND WHEREAS the National Redemption Council deems it fit to give due effect to the said finding of the said Committee of Inquiry:

NOW, THEREFORE, in pursuance of the National Redemption Council (Establishment) Proclamation, 1972 this Decree is hereby made:

Section 1—Mahamadu Abudulai’s Enskinment, Etc.  Declared Null and Void.

The purported nomination, selection and enskinment of Mahamadu Abudulai as Ya-Na and Paramount Chief of Dagbon is hereby declared to be null and void for all purposes whether under customary law or otherwise.

Section 2—Mahamadu Abudulai not to Purport to be Chief.

(1) Mahamadu Abudulai shall not—

(a) purport to be Ya-Na or Paramount Chief of Dagbon whether under customary law or otherwise;

(b) in any manner assert any claim to be Ya-Na or Paramount Chief of Dagbon;

(c) do any act tending to incite disaffection against Ya-Na Yakubu II, Paramount Chief of Dagbon.

(2) If the said Mahamadu Abudulai contravenes any provision of subsection (1) of this section he shall be guilty of an offence and liable on conviction to a term of imprisonment not exceeding ten years without the option of a fine.

Section 3—No Person to Recognise Mahamadu Abudulai.

(1) No person shall—

(a) recognise Mahamadu Abudulai as Ya-Na or Paramount Chief of Dagbon whether under customary law or otherwise;

(b) in any manner support, encourage or canvass any claim of Mahamadu Abudulai to be Ya-Na or Paramount Chief of Dagbon;

(c) do any act tending to incite disaffection against Ya-Na Yakubu II, Paramount Chief of Dagbon.

(2) Any person who contravenes any provision of subsection (1) shall be guilty of an offence and liable on summary conviction to a fine not exceeding one thousand cedis or to imprisonment not exceeding two years or to both.

Section 4—Application.

The provisions of this Decree shall apply notwithstanding any enactment, customary law or any other law to the contrary.
